A Holistic Approach to problems at work
We understand you are likely to be in the middle of a very stressful situation. You may be worried about your future income, the effect on your reputation or even your career. There are emotional aspects of work-related issues that few solicitors understand. As we only advise individuals, we are acutely aware of these unique pressures. We navigate hundreds of employees through a variety of work-related situations like yours every year. We are on your side every step of the way.
How we can help
We can help you at any stage of your employment including:
Before you start
For example, in reviewing your Contract of Employment or negotiating the package and terms, such as detail or enforceability of post-termination restrictive covenants.
Problems at work
This includes bullying, harassment, discrimination, whistleblowing and other grievance issues across the spectrum of disputes. We provide legal, practical and tactical advice on your unique circumstances so that we obtain the outcome you wish to achieve.
Disciplinary or Dismissal
We regularly advice on internal disciplinary matters, helping you achieve the result you want. This may be to defend the allegations, leave with your reputation in tact or negotiate a severance. If your employer has unfairly dismissed you, forced you out, or made you redundant, we can help you challenge the decision internally, pursue justice through the Tribunal if you are dismissed or negotiate a suitable severance package to safeguard your future.
Exit Strategies
Once you decide to leave your employment, there are lots of issues to consider. You may wish to secure the best financial position on exit, such as making a good case for a pro-rata bonus, or safeguard your future in your new role by renegotiating restrictive covenants in your contract. We can advise and assist you in formulating your own strategy based on your unique circumstances and interests you wish to protect.
Settlement Agreement
You may have been asked to sign an agreement by your employer to agree to the end of your employment, in consideration of a certain sum of money. Settlement Agreements are frequently used as ways of settling disputes between employees and employers covering a range of different situations. Once you sign, you are agreeing not to bring certain legal claims against your employer. In this way, your legal rights and claims are ‘settled’. We can assist you in understanding what you have been offered, discuss your options and advise you on tactics and strategies to maximise the package offered by your employer. We frequently find an employee does not know the strength of their negotiating position until they speak with us.
Post Termination advice
After you have left your employment, you may need to ensure you can continue conducting your work, often in competition with your former employer, without any concerns. If there are restrictive covenants in your contract of employment, it is imperative you seek legal advice on their enforceability. The consequences of breaching a restrictive covenant can be expensive. We can advise you whether it is likely a court would deem the restriction valid and, if so, strategies and tactics to adopt to ensure minimal risk and maximum freedom in your new job.
Practical advice and onward referrals
Often, the answer a client needs is not a legal one; or at least the initial step maybe a medical referral, for example. We are committed to helping you in whatever manner you need and will always put you first. This often means we advise clients to not waste money instructing a lawyer; instead to contact their GP or perhaps invoke an internal process with their employer first. We are always here to help but would genuinely prefer the right result for you. Just tell us how it went! We like stories that end well.
